Terms of Service

Effective date: 1 April 2026

1. About TapText

TapText (“we”, “us”, “our”) is an Australian SMS widget platform that allows businesses to receive text messages from their website visitors. By creating an account and using TapText, you (“you”, “the customer”) agree to these Terms of Service.

2. Eligibility

You must be at least 18 years old and operating a legitimate business to use TapText. By signing up, you confirm that all information you provide is accurate and that you have the authority to bind your business to these terms.

3. Free Trial & Billing

All plans include a 14-day free trial. We collect your payment details at signup but will not charge your card until the trial ends on day 15. You may cancel at any time before day 15 and will not be charged. After the trial, your subscription renews monthly. You can cancel at any time — no lock-in contracts.

All prices are in AUD and inclusive of 10% GST. Subscription fees are charged in Australian dollars (AUD) and are non-refundable except where required by Australian Consumer Law. Pricing is as listed on our website and may change with 30 days' notice.

4. SMS Usage & Limits

Each plan includes a monthly outbound SMS allocation (Base: 150 SMS/month, Build: 300 SMS/month, Boost: 500 SMS/month). Inbound SMS received from your customers are always free and do not count against your allocation. SMS usage is calculated per billing period starting from your subscription start date. Unused SMS do not roll over to the next period.

If you reach your monthly SMS limit on the Base or Build plan, you will be notified and prompted to upgrade to the next plan tier for the remainder of that billing period. Your service will continue uninterrupted. You may request to return to your original plan at the start of your next billing period. TapText does not charge per-SMS overage fees — plan upgrades are the mechanism for accessing additional SMS capacity.

* Boost plan customers who reach or approach their monthly SMS limit will be contacted by TapText to discuss a custom arrangement. As the highest available plan tier, standard auto-upgrade is not available. TapText will work with you to find an appropriate solution — which may include a custom volume arrangement, a temporary limit extension, or other options depending on your usage pattern. You will receive advance notice before your service is affected.

5. Acceptable Use

You agree not to use TapText to:

  • Send spam, unsolicited marketing, or bulk SMS campaigns
  • Harass, threaten, or abuse any person
  • Violate any applicable Australian or international laws
  • Send content that is illegal, defamatory, obscene, or harmful
  • Interfere with or disrupt TapText's infrastructure
  • Impersonate another person or business

TapText is designed as a customer enquiry channel — a way for website visitors to reach you. It is not a bulk messaging or marketing platform. Misuse will result in account suspension.

6. Your Data & Privacy

You are responsible for the customer data that flows through your TapText account, including phone numbers and message content. You must handle this data in compliance with Australian Privacy Principles and any other applicable privacy laws. Our collection and use of your data is described in our Privacy Policy.

7. Service Availability

We aim to provide a reliable service but cannot guarantee 100% uptime. We are not liable for any losses caused by service interruptions, delays, or outages. SMS delivery is also subject to the conditions of third-party telecommunications providers (including Twilio and Australian carriers), over which we have no control.

8. Intellectual Property

TapText retains all intellectual property rights in the platform, including software, design, and documentation. You retain ownership of your business data and customer messages. You grant us a limited licence to process and store your data solely for the purpose of providing the service.

9. Termination

You may cancel your account at any time via the billing page. We may suspend or terminate your account if you breach these terms, with or without notice depending on severity. Upon termination, your data will be retained for 30 days and then deleted, unless we are required by law to retain it longer.

10. Limitation of Liability

To the extent permitted by law, TapText's liability is limited to the amount you paid us in the 30 days prior to the claim. We are not liable for indirect, consequential, or incidental losses, including lost revenue or data.

Nothing in these terms limits any rights you may have under the Australian Consumer Law.

11. Changes to These Terms

We may update these terms from time to time. We'll notify you by email at least 14 days before material changes take effect. Continued use of TapText after that date constitutes acceptance of the updated terms.

12. Governing Law

These terms are governed by the laws of Queensland, Australia. Any disputes will be resolved in the courts of Queensland.
